4.1 Product Descriptions

We strive to display our products as accurately as possible, including images, descriptions, sizes, and colors. However, we do not guarantee that product images on screen exactly match the physical product, as colors may vary depending on your device's display settings.

4.2 Pricing

All prices listed on our website are in Pakistani Rupees (PKR) and are inclusive of applicable taxes unless stated otherwise. Apex Sneakers reserves the right to change prices at any time without prior notice. The price charged at the time of order confirmation is final.

4.3 Product Availability

All products are subject to availability. We reserve the right to limit quantities or discontinue any product at any time. In the event that an ordered item is out of stock, we will notify you promptly and offer a replacement, store credit, or full refund.

4.4 Errors and Inaccuracies

In the event of a pricing error or product listing mistake, Apex Sneakers reserves the right to cancel any orders placed at the incorrect price, even after an order confirmation has been sent. We will notify you of such cancellations and issue a full refund.

5. Orders and Payments

5.1 Placing an Order

By submitting an order, you are making an offer to purchase a product. An order is only confirmed once you receive a confirmation message or email from Apex Sneakers. We reserve the right to refuse or cancel any order at our discretion.

5.2 Accepted Payment Methods

We currently accept the following payment methods:

  • Cash on Delivery (COD) — available in selected cities across Pakistan
  • EasyPaisa
  • JazzCash
  • Bank Transfer (account details provided at checkout)
  • Credit / Debit Card (Visa, Mastercard)

5.3 Payment Security

Apex Sneakers does not store your full card or banking details. All electronic payments are processed through secure, encrypted channels. However, we are not responsible for unauthorized access to your payment information that occurs outside our systems.

5.4 Order Cancellation by Apex Sneakers

We reserve the right to cancel orders in the following cases:

  • Product is out of stock or discontinued.
  • Suspected fraudulent activity or policy abuse.
  • Incorrect pricing or listing error.
  • Failure to confirm COD order via phone or WhatsApp within 24 hours.
  • Delivery address is outside our serviceable areas.

6. Shipping and Delivery

6.1 Delivery Areas

Apex Sneakers currently delivers across major cities and regions of Pakistan. Delivery to remote or non-serviceable areas may not be possible. You will be informed at checkout if delivery to your location is unavailable.

Delivery timelines are estimates and may vary due to courier delays, public holidays, or unforeseen circumstances.

6.3 Shipping Charges

Shipping charges, if applicable, will be displayed at checkout before order confirmation. Apex Sneakers may offer free shipping on orders above a specified amount, subject to promotional terms.

6.4 Risk of Loss

Risk of loss and title for products purchased from Apex Sneakers passes to you upon delivery to the specified address. Apex Sneakers is not liable for items lost or damaged after confirmed delivery.

7. Refunds and Returns

All refund and return requests are governed by our separate Refund & Return Policy, which forms part of these Terms and is incorporated herein by reference. Please review that policy before making a purchase.

8. Intellectual Property

All content on the Apex Sneakers website and social media pages — including but not limited to logos, brand name, product images, text, graphics, videos, and design elements — is the exclusive intellectual property of Apex Sneakers and is protected under applicable Pakistani and international intellectual property laws.

You may not:

  • Copy, reproduce, or distribute our content without written permission.
  • Use our brand name, logo, or images for commercial purposes.
  • Modify or create derivative works based on our content.
  • Scrape or harvest data from our website using automated tools.

9. User Conduct

By using our website and services, you agree not to:

  • Provide false, misleading, or fraudulent information during checkout or communication.
  • Use our platform for any unlawful purpose or in violation of Pakistani law.
  • Engage in abusive, threatening, or harassing behaviour toward our staff or team.

  • Place orders with no intention to pay or accept delivery (COD fraud).
  • Manipulate reviews, ratings, or feedback in a dishonest manner.
  • Resell our products commercially without prior written authorization.

Apex Sneakers reserves the right to block, blacklist, or take legal action against users who violate these conduct standards.

10. Cash on Delivery (COD) Policy

COD orders are subject to verbal or WhatsApp confirmation before dispatch. Repeated rejection of COD orders at the doorstep without valid reason may result in:

  • Restriction of COD as a payment option for future orders.
  • Account blacklisting.
  • Recovery of shipping charges incurred due to rejected delivery.

By placing a COD order, you commit to being available at the provided address during the estimated delivery window and accepting the parcel upon arrival.

11. Privacy and Data

Your personal information — including name, phone number, address, and payment details — is collected solely for the purpose of processing and delivering your order and improving our services. We do not sell or share your data with third parties for marketing purposes without your consent.

By placing an order or contacting us, you consent to being contacted via WhatsApp, SMS, or phone call for order-related updates. You may opt out of promotional messages at any time by contacting our support team.

12. Limitation of Liability

To the fullest extent permitted by law, Apex Sneakers shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our products or services, including but not limited to:

  • Delays in delivery due to courier or logistical failures beyond our control.
  • Loss of data or unauthorized access to your account.
  • Personal injury caused by improper use of the product.
  • Dissatisfaction with product fit, style, or appearance where the product matches its listed description.

Our total liability in any claim related to a purchase shall not exceed the amount paid for the specific order in question.

13. Disclaimer of Warranties

Apex Sneakers provides all products and services on an "as is" and "as available" basis. We make no warranties — express or implied — regarding the fitness of our products for a particular purpose beyond what is explicitly stated in the product listing.

We do not guarantee uninterrupted, error-free access to our website or order processing systems.

14. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes arising out of or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in Rawalpindi / Islamabad, Pakistan.

In the event of a dispute, we encourage you to first contact our customer support team to resolve the matter amicably. We aim to resolve all complaints within 5–7 business days. If a resolution cannot be reached informally, the matter may be escalated to the relevant legal authorities as per Pakistani law.

Apex Sneakers reserves the right to update or modify these Terms of Service at any time without prior notice. Changes will take effect immediately upon being posted on our website. Continued use of our services after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

17. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable Pakistani law, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms of Service, together with our Refund & Return Policy and Privacy Policy, constitute the entire agreement between you and Apex Sneakers with respect to your use of our services and supersede any prior agreements or understandings.
